1. Unless otherwise endorsed by Council, a security bond is payable as a guarantee of fulfilment of conditions and as a security against damage to any part of the facility. The approval holder shall be liable, on demand, to pay any further amount in excess of such bond to meet the full cost of damage or additional cleaning. The bond will be released within 10 business days if all conditions are met.
2. Hire fees are in accordance with Council’s adopted Fees and Charges and are payable prior to collection of keys for the facility being hired. If paying the hire fees and security via cheque, payment must be received three 3 business days prior to allow time for the cheque to clear.
3. Keys may be collected from Council’s Administration Centre before 4:00pm on the working day prior to the event and must be returned by 8:30am the next working day after the event. Additional hire fees may apply after this time.
4. At all times, the requirements of the Tobacco and Other Smoking Products Act 1998 must be observed. In particular, the requirement that a person must not smoke within 4 meters of any part of an entrance. Further, no smoking is allowed inside any Council venue.
5. The approval holder must conform to the requirements of the Public Health Act 2005, Liquor Act 1992 and Local Government Act 2009 and any local law or regulations made thereunder and shall be liable for any breach of such Acts, local laws or regulations. All other statutory rules, provisions and regulations of the Commonwealth of Australia or State of Queensland must be complied with, including noise and public disturbance legislation.
6. The sale of liquor on the premises is forbidden unless the approval holder obtains a permit from the appropriate authority and the permit is produced to Council for endorsement.
7. The approval holder must not use, or permit the use of, the premises for an open-air event on any day (a) before 7am, if the use causes audible noise; or
(b) from 7am to 10pm, if the use causes noise of more than 70dB (A); or
(c) from 10pm to midnight, if the use causes noise of more than the lesser of the following—
(i) 50dB (A)
(ii) 10dB (A) above the background level.

8. It shall be at Council’s discretion to refuse to grant the hire of the facility and, notwithstanding that permission to hire the facility may have been granted or that these conditions may have been accepted and signed and the fees and deposit paid, Council shall have the power to cancel such permission and direct the return of the fees and deposits so paid.
9. The approval holder must keep and maintain all facilities and equipment used in the undertaking of the event in good working order and condition and in a clean, tidy and sanitary condition. All refuse is to be deposited into the wheelie bins provided and left at the designated collection areas. (See Condition 17)
10. The approval holder shall be responsible for the full observance of these conditions and for the maintenance and preservation of good order and a high standard of behavior in and about the premises throughout the whole duration of the period of use.
11. Any additional cost incurred by Council in cleaning the premises resulting from the condition in which the approval holder left the premises shall be recoverable from the approval holder. So as there is no dispute concerning cleaning, the expectation is that the premise is left in the same condition as it was upon arrival.
12. The amenities will be stocked with consumables (e.g. toilet paper, hand towel, hand soaps) at time of handover. It is the hirer’s responsibility to provide all further necessary consumables for the duration of hire. All cleaning equipment and supplies are also to be provided by the hirer.
13. The approval holder shall not assign the right of use to any person, organisation, or body, without Council approval first being obtained.
14. This approval is to be produced for inspection on demand by an authorised person, who shall at all times be entitled to free access to any and every part of the building.
15. The approval holder must protect the safety of persons who may be involved in, or affected by, the activities authorised by the approval.
16. The approval holder must ensure that the insurance policy submitted to Council with the application is maintained for the entire duration of the activity.
17. The approval holder must ensure that any waste generated by the undertaking of the event is disposed of in a manner which maintains the site of the activity and its surrounds in a safe, clean, tidy, sanitary and hygienic condition. Waste must not be disposed of so as to attract pests, into a watercourse or at another location other than a location properly intended for the receipt of the waste. Refuse is to be deposited into the wheelie bins provided and placed in the camping area for collection.
18. The approval holder must promptly report to Council staff and rectify any damage or loss of amenity to a local government controlled area or road caused by the undertaking of the event. This includes any damage to furniture, equipment, fittings, irrigation, pipes, fauna, flora, lawns and grassed areas.
19. Neither Council nor its servants shall be liable for any loss or damage sustained by the approval holder or any person, firm or corporation entrusting to or supplying any article or thing to the approval holder by reason of any such article or thing being lost, damaged or stolen. The approval holder hereby indemnifies Council against any claim by any such person, firm or corporation in respect of such article or thing.
20. The Sallatina Hall and Shepherd Pavilion have been approved for use by the hirer.
21. For certain major functions (as determined by Council), the approval holder shall supply to Council, Police crowd control procedures for approval, prior to use.
