EARLY CANCELLATION FEE SCHEDULE

The Early Cancellation Fee depends on the Monthly Data Bundle option that has been selected and the number of days that service has been active on that Monthly Data Bundle prior to service cancellation or a plan change request.

USAGE MONITORING

If the Customer does not specify a Monthly Usage Threshold, Outfitter Satellite reserves the right to set it.

DESCRIPTION OF MONITORING SYSTEM: The monitoring system measures Standard IP Data usage; other types usage including voice calls and Streaming IP data are not monitored. If the monitoring system detects total Standard IP Data usage during a given month that exceeds the “Monthly Usage Threshold” then a Suspension of Service to the terminal/SIM card will automatically occur (subject to the Limitations described below).
 
SUSPENSION OF SERVICE: Suspension of service by the monitoring system stops all service types including voice, SMS, Standard IP data and Streaming IP data. No further communication services are possible until the monitoring system is reset at the request of the Customer or an Authorized User on the account by contacting Outfitter Satellite Technical Support at 615-889-8833. All monthly service fees continue to apply even for periods during which suspension of services by the monitoring system is in place.
 
MONTHLY RESET OF MONITORING SYSTEM: The monitoring system will automatically reset its counter on the first of each month except in the case where service has been suspended by the monitoring system, Once suspended, service can only be resumed by resetting the monitoring system which requires that the Customer or an Authorized User contact Outfitter Satellite Technical Support at 615-889-8833.
ALERT NOTIFICATIONS: The monitoring system can be configured at the request of the Customer or an Authorized User to send email alert notifications when it detects that 50% or 75% of the Monthly Usage Threshold has been exceeded.
CHANGING THE CONFIGURATION OF THE MONITORING SYSTEM: The above Monitoring System configurations can be changed by the Customer or Authorized User(s) on the account.
 
LIMITATIONS: Call detail records are normally analyzed by the monitoring system every 60 minutes, and if the monitoring system determines that the Monthly Usage Threshold has been exceeded, an automatic suspension of service to the terminal/SIM card should normally occur less than 20 minutes thereafter. To be clear, this means that even if the monitoring system is operating normally, the terminal/SIM card can pass traffic for as much as 80 minutes before a suspension of service goes into effect. The monitoring system also can be impacted by scheduled or unscheduled outages, and traffic/usage that occurs during such outages may not be accounted for correctly resulting in overrunning of the Monthly Usage Threshold. THE CUSTOMER ACKNOWLEDGES THAT THE MONITORING SYSTEM IS ONLY AN AID TO HELP CONTROL STANDARD IP DATA USAGE, BUT IT IS NOT A PREPAID USAGE SYSTEM. THE CUSTOMER ACKNOWLEDGES THAT ADDITIONAL USAGE — POTENTIALLY SIGNIFICANT ADDITIONAL USAGE — BEYOND THE MONTHLY USAGE THRESHOLD CAN OCCUR, AND THE CUSTOMER REMAINS LIABLE FOR ALL ACTUAL USAGE THAT OCCURS EVEN IF THE MONITORING SYSTEM FAILS TO PERFORM AS EXPECTED DUE TO MONITORING SYSTEM ERRORS, SCHEDULED OR UNSCHEDULED MAINTENANCE, CDR DELAYS, PARTIAL CDR FILES, USER MISUNDERSTANDINGS, CLERICAL ERRORS ON THE PART OF OUTFITTER SATELLITE OR ITS VENDORS, OR ANY OTHER REASON.

TERMS AND CONDITIONS

Payment Method: Credit approval is based on a valid U.S. credit card, substantial deposit, approved company purchase order, or a Dunn & Bradstreet credit report. By default, the Customer’s credit card will be billed automatically each month for the charges described in this agreement. If Customer does not provide the U.S. credit card for the automatic monthly billing, an additional $2 per month per phone charge will apply, and the Customer agrees to pay within 30 days of the statement date for service continuation. Payment must be made by check drawn on a US bank, money order, wire transfer, or a U.S. credit card.
 
Description: The customer agrees to pay for all voice and data usage originating from or received at the rates shown in this agreement. The Customer acknowledges having read and agrees to the Iridium Fair Use Policy found at www.OutfitterSatellite.com/adobe/Iridium-Fair-Use-Policy.pdf. The Customer also acknowledges having read and agrees to the limitations of the Usage Monitoring services described below. Definitions: PSTN refers to Public Switched Telephone Number; KB refers to a kilobyte of data; MB refers to a megabyte of data; GB refers to a gigabyte of data. For the purposes of this contract 1000 bytes equals 1 KB; 1000 KB equals 1 MB; 1000 MB equals 1 GB.
 
Voice Calls: Voicemail is included. Voice calls are measured and charged in one minute increments with one minute minimum at the rates shown in the above chart. If a call is direct dialed to the Iridium 12-digit mobile number (with 8816 country code), the calling party pays for the call through their own carrier and no charge is billed to the Iridium SIM card account for receiving the call. Local Access Number(s) refer to a US phone number for receiving inbound phone calls. Inbound calls that are forwarded to Iridium voicemail or other third party numbers remain billable. Customer is advised that other types of calls not shown in the rate chart can be at much higher rates, and Customer is responsible to know the rate before making the call.
 
Monthly Voice Bundle: The Monthly Voice Bundle only applies to mobile-originated voice calls made to PSTN numbers, cellular numbers, other Iridium phone numbers, or your Iridium voicemail. The Monthly Voice Bundle does not apply to any calls made over a “Crew Line.” All other types of calls are out-of-bundle calls and will be billed at the rates shown in this agreement. Unused minutes from the Monthly Voice Bundle do not roll over and are lost.
 
Standard IP Data: The Monthly Data Bundle only applies to Standard IP data. The unused part of the Monthly Data Bundle is lost and does not roll to a subsequent month. Additional Standard IP data will be billed at the specified Out-of-Bundle Data rate. Standard IP data is offered on a best-effort shared-bandwidth basis and access sessions are billed in 1 KB increments with a 5 KB minimum per session.
 
Limitations: Short Burst Data (SBD) is disabled by default on this plan but can be enabled (contingent on availability) by separate amendment to this agreement made in writing. Streaming IP Data is disabled by default on this plan but can be enabled by Customer request (contingent upon credit approval and availability). Unless a separate Streaming IP Data amendment to this agreement is made in writing, all Streaming IP data usage will be billed at $29.95 per minute (in 30 second increments with a 30 second minimum) regardless of the Streaming IP data rate selected.
 
Minimum Term Commitment: The Initial Term for this service agreement is measured from the activation date of the specific Unit being provisioned, and the month of activation counts as the first whole month of the Initial Term. If the service is cancelled prior to the end of the Initial Term, the early cancellation charge indicated above will be billed as a one-time fee. After the Initial Term is completed the Service Agreement has automatic one (1) month renewal terms for each subsequent month and the customer can cancel without penalty at any time.
 
Plan Changes: Downgrading to a Plan with a smaller Monthly Data Bundle during the Initial Term results in the early cancellation charge indicated for the original plan as indicated in Appendix A. There is no charge to upgrade to a plan with a larger Monthly Data Bundle during the Initial Term, and there is no charge to upgrade or downgrade once the Initial Term commitment has been met. The change to the new Plan will be effective on the first day of the subsequent month (the “effective date”), and a new Initial Term commitment associated with the new Plan will begin as of that effective date.
 
Cancellation Procedure: To cancel service, the Customer must provide Outfitter Satellite with an express written, signed intent to cancel. The Customer remains responsible for airtime and other usage until 3 business days after the Customer’s requested service cancellation date, and if this service cancellation date is after the 25th of a month, the Customer is liable for any service fees to be billed in the subsequent month. Upon cancellation, there is no refund or proration for any service fees. Cancellation notices must be sent to info@OutfitterSatellite.com or faxed to 615-902-0028 or mailed to 2727 Old Elm Hill Pike, Nashville, TN 37214 USA.

CREDIT CARD INFORMATION

IMPORTANT:  Before your service is activated and/or your order is shipped, you must submit your credit card information into our secure credit card web portal.  Once we receive your completed service agreement, our customer service team will send an email to the main email address listed on this form with an enclosed link to our secure credit card portal where you will enter and save your credit card information.  Service agreements received outside of normal business hours will be processed the following business day.   We cannot activate service if the credit card information or Security Code for the card cannot be verified by our system. 

For your protection, Outfitter Satellite systems or personnel do not see your full credit card information.   Our billing system only stores tokenized information to enable it to use the card to pay future charges related to the service (or rental) agreements active under your account.   For future card identification, we retain the card type, the last four digits of the card, and the expiration date. 

By signing below, you warrant that you are the Cardholder or an authorized user of any card that is entered into the secure credit card web portal and agree that all charges described in this agreement (and any other service or rental agreements) made between OUTFITTER SATELLITE, INC. and the above named Customer can be made to the Cardholder’s credit card.  You warrant all the information that you are submitting is accurate and that the credit card that you are supplying through the secure credit card web portal is being supplied as a guarantee that all the charges described in this agreement (and any other service or rental agreements on the Customer’s Outfitter Satellite account) will be paid.

What is an Authorized User with Full Access rights?  An Authorized User with Full Access rights is authorized by the Customer to discuss and view all rental and usage bills including detailed call records and make changes to rental or service plans including canceling service or activating new service, and receive technical support as per the terms of this agreement or other agreements executed separately by the Customer.

Why do we need you to name additional Authorized Users?   For corporate accounts,  naming the Accounts Payable person for your company an Authorized User is necessary to allow them to discuss billing issues and information.  It is also useful for us to identify other people within the company that can discuss billing issues, make purchases, or receive technical support related to your account in the event we are unable to reach you.

What is an Authorized User with Full Access rights versus Technical Support rights only?  An Authorized User with Full Access rights is authorized by the Customer to discuss and view all rental and usage bills including detailed call records and make changes to rental or service plans including canceling service or activating new service, and receive technical support as per the terms of this agreement or other agreements executed separately by the Customer. A customer with Technical Support rights is only authorized to receive technical guidance on the use of the satellite communications equipment.

I UNDERSTAND THAT AN IRIDIUM SATELLITE PHONE NEEDS A CLEAR LINE OF SIGHT TO THE IRIDIUM SATELLITE AND THAT THE PRESENCE OF VERTICAL OBSTRUCTIONS SUCH AS NEARBY TREES, MOUNTAINS AND BUILDINGS CAN RESULT IN FREQUENT CALL DROPS.  I FURTHER UNDERSTAND THAT CONTINUING TO ATTEMPT TO MAKE CALLS WHILE NEAR THESE VERTICAL OBSTRUCTIONS CAN RESULT IN A SERIES OF BILLABLE SHORT DURATION CALLS, AND I AGREE TO PAY FOR THESE CALLS.  MOVING TO A NEARBY CLEARING OR MOVING AWAY FROM BUILDINGS AND TREES AND WAITING FOR A STRONG SIGNAL ON THE SATELLITE PHONE BEFORE INITIATING CALLS WILL HELP REDUCE THE FREQUENCY OF CALL DROPS.
